Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Peak Scroll platform and services (the "Service") operated by Peak Scroll ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you do not have permission to access the Service.

1. Description of Service

Peak Scroll is a Software-as-a-Service (SaaS) platform that allows users to automate, schedule, and publish content—including text, images, video ads, reels, statuses, and comments—to third-party social media profiles, pages, groups, and channels.

The Service includes tools that facilitate the deployment of both:

1.     Client-Provided Content: Media, copy, and assets uploaded directly by you.

2.     AI-Generated Content: Text, images, videos, hashtags, and responses generated via third-party artificial intelligence engines integrated into Peak Scroll.

Supported platforms include, but are not limited to, Facebook, Instagram, X (formerly Twitter), TikTok, Reddit, Discord, Pinterest, and YouTube.

2. Accounts and Security

·        Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction) to use this Service.

·        Account Accuracy: You must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms.

·        Credentials: You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

·        Unauthorized Use: You agree to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Social Media Account Integration

·        Authorized Access: By linking any third-party social media account, page, group, or channel to Peak Scroll, you represent and warrant that you own the account or have explicit, legal authorization to publish content to it.

·        Compliance with Third-Party Rules: You agree to abide entirely by the terms of service, community guidelines, and developer policies of all connected networks (e.g., Meta Terms, YouTube Terms of Service, X Rules, TikTok Terms, etc.).

·        Platform Disruption: Peak Scroll is not liable for any actions taken against your accounts by third-party networks (such as shadowbans, account suspensions, or reach restrictions) resulting from your automation or posting habits.

4. Content Responsibility and Acceptable Use

You retain ownership of any data or custom media you upload to the platform. However, you are solely responsible for all content published through your Peak Scroll account.

Prohibited Content & Behavior

You strictly agree NOT to use Peak Scroll to generate, schedule, or publish content that:

·        Infringes on the intellectual property, copyright, or trademark rights of any third party.

·        Contains sexually explicit content, illegal activities, hate speech, harassment, defamation, or incites violence.

·        Generates or distributes deceptive spam, malicious links, or coordinated inauthentic behavior across social channels.

·        Violates local, state, national, or international laws.

Our Right to Moderate: We reserve the right, but not the obligation, to review, flag, or remove content within our platform, or terminate accounts that we determine, in our sole discretion, violate these Acceptable Use guidelines.

5. Artificial Intelligence (AI) Features

For features involving AI-generated text, images, videos, comments, or hashtags, the following rules apply:

·        No Guarantee of Accuracy: AI-generated outputs are produced algorithmically. Peak Scroll does not guarantee the factual accuracy, legality, uniqueness, or appropriateness of any AI-generated content. You must review all AI outputs before publishing.

·        Copyright and Ownership: Ownership and copyright of AI-generated content can be subject to complex legal frameworks that vary by country. Peak Scroll claims no ownership over the outputs generated from your prompts.

·        Provider Terms: Your use of our AI tools is also subject to the upstream policies of our AI sub-processors (e.g., OpenAI, Anthropic). You may not use our tools to intentionally bypass safety guardrails or generate prohibited materials.

6. Subscriptions, Fees, and Cancellations

·        Billing: Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (monthly or annually), depending on the plan you select.

·        Price Changes: We may modify subscription fees at any time. Any fee change will become effective at the end of the then-current billing cycle, and we will provide you with reasonable prior notice.

·        Cancellations: You may cancel your subscription at any time through your account dashboard. Your access will continue until the end of your paid billing period.

·        Refunds: Except when required by law, paid subscription fees are non-refundable.

7. Intellectual Property

The Peak Scroll platform, its original content (excluding content provided by users), features, interface, and backend functionality are and will remain the exclusive property of Peak Scroll and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.
